Institutions must navigate heightened exposure under Title IX, discrimination and affirmative‑action litigation, antisemitism‑related complaints, and escalating tensions around campus protests and controversial speakers—all while managing the operational and reputational fallout these conflicts generate. At the same time, insurers are raising premiums, narrowing coverage and, in some cases, retreating from the higher‑education sector entirely, leaving institutions with fewer safety nets for their most significant legal risks.
